It seems Ghostscript is looking for a CR and/or LF after the %%EOF marker.
The PDF specification doesn't mention this at all and Acrobat/Reader parses
the file correctly.

Our own PDF consumer code handles both cases but our software is writing
%%EOF as the last five bytes of the file.

Very interesting. The best solution would be to put either a CR or LF at the
end of the line as Acrobat handles the %%EOF marker anywhere in the last
1024 bytes of the file.

We've updated our library accordingly... thanks for the info. I've attached
a replacement file, the version in the /Producer field is now 3.61.
